DETERMINATION OF SEA BOUNDARIES FROM THE PERSPECTIVE REGION OF THE REPUBLIC OF INDONESIA

The Djuanda Declaration was proclaimed on December 13, 1957, but it was only in 2000 that an obligation
was issued for the Government of the Republic of Indonesia to determination of sea boundaries as stated in the amendments to the 1945 Constitution. Several regulations related to sea boundaries and maritime zone actually already exist, namely: Law on the Indonesian Continental Shelf (1973), Law on Indonesia’s Exclusive Economic Zone (1983), and Law on Indonesian Waters (1996). The Government of Indonesia, for the first time in 1999, issued a Law on Regional Government, which states that there is regional authority in managing sea areas as far as 12 nautical miles from the coastline. This paper examines the extent of the relationship between determining the sea boundary of the Republic of Indonesia based on the United Nations Convention on the Law of the Sea (UNCLOS) in 1982 with the regional sea boundary that refers to the Law on Regional Government. The research method employed is an analysis of the correlation between laws and regulations related to national and regional sea boundaries. The results showed that the determination of the national sea boundary uses the baselines that refer to the lowest sea level position, while for the regional uses the coastlines at the highest tide position. This shows that there is no link at all between the national sea boundary and the regional sea boundary of the Republic of Indonesia.
